Standard terms Music subscription
READ THE TERMS AND CONDITIONS CAREFULLY
The following standard terms and conditions apply to all subscriptions regarding access to the music portal Radiosparx.com from RadioSparx Scandinavia ApS, CVR 34 59 17 25. The terms and conditions form an integral part of any subscription agreement between the customer and RadioSparx Scandinavia ApS and the standard terms and conditions can always be viewed at www.radiosparx.co.uk.
1. Entry into force, termination and binding period
Subscription runs from the start date specified in the subscription agreement. The subscription has a commitment period corresponding to the selected subscription period of̊ 1, 3, 6 or 12 months from the start date.
At least 30 days before the end of the binding period, the customer can cancel his subscription. Subscriptions taken out via the webshop can be canceled via login at ̊www.radiosparx.co.uk and stop automatic payment. Alternatively, subscriptions can be canceled by email to info@radiosparx.dk.
If the subscription is not terminated, a new subscription period begins automatically with the period/payment interval stated in the subscription agreement.
2. Content, maintenance
Radiosparx.com contains a wide variety of music in different genres. RadioSparx Scandinavia ApS reserves the right to change, add or delete channels and music tracks without prior notice.
In the event of a malfunction of radiosparx.com, a restart of the customer’s music player will usually be able to remedy the problem. Otherwise, the customer can contact the support department, who will try to identify and remedy the problem.
3. Use of subscription, responsibility for use of password etc.
RadioSparx.com works best in connection with a broadband connection.
A single-user subscription only allows you to play from www.radiosparx.com on a single music player/IP address. Similarly, a multi-user subscription allows you to play from the number of players corresponding to the number of users subscribed to in the subscription.
The customer’s username and password belong to and can only be used by the customer. The customer is obliged to protect his username and password against unauthorized use.
The subscription, including all or part of the content on radiosparx.com, can only be used as background music in e.g. shops, shopping malls, restaurants, cafes, spas, hotels, lobbies, etc.
The customer may not use the subscription, including all or part of the content, for any other type of use. Illegal use may be prosecuted. Prohibition of illegal use can be lifted without collateral. The customer is responsible for any use of the customer’s subscription and also assumes responsibility for any activity that can be attributed to the use of the customer’s username and password.
If the customer becomes aware of the risk of, or actual illegal use of, their username and password, or if the customer assumes that there is a future risk of this, the customer must immediately contact customer service.
The content on RadioSparx.com is selected for use in Scandinavia. It is the customer’s IP address that informs the music server of the customer’s geographical position and ensures the customer access to the right content on radiosparx.com. Deactivation of the customer’s geographic position or any manipulation or “spoofing” of the customer’s web device, IP address or other activities/conditions that cause us to receive an incorrect geographic destination for the customer may have the consequence that the content that the customer uses is not intended for use in Scandinavia. The customer thus risks being obliged to pay fees for the use of the content. RadioSparx Scandinavia ApS is not responsible for this, regardless of the reason for this.
Radiosparx.com may appear to be unavailable/inoperative due to external factors beyond our control and for which we cannot be held responsible, including but not limited to environmental or topographical conditions, lowered or limited internet connectivity, problems with the customer’s web browser, computer, cable faults or operational disruptions at the customer’s internet provider.
In the event of operational disruptions on radiosparx.com which can be documented as being caused by RadioSparx Scandinavia ApS, with a duration exceeding 24 hours, this will result in an extension of the subscription period corresponding to the downtime. Downtime cannot be considered a default. However, the agreement can be terminated if there is a total downtime of 72 hours or more, until the end of the current month.
4. Price adjustment and payment terms
The subscription is paid in advance with the payment terms specified in the subscription agreement. RadioSparx Scandinavia ApS reserves the right for price increases that correspond proportionally to the price increases that may be imposed on our content supplier, annually in relation to the net price index from Statistics Denmark. Price increases are notified in writing with min. 30 day notice. No price increases are announced for the binding period. Upon termination of the agreement, for whatever reason, no refund will be made. prepaid amounts.
5. Default
The customer’s significant breach of the agreement, including but not limited to non-payment of due amounts and use of the subscription in violation of point 3, gives RadioSparx Scandinavia ApS the right to cancel the subscription without notice. In the event of cancellation, the customer remains responsible for payment of all outstanding amounts at the time of cancellation or other claims that may have arisen because of the agreement and/or the breach.
6. Customer service, changes made to the customer’s contact information, etc.
In case of questions about service, the subscription, the payment, the invoice, or anything similar, the customer is asked to contact customer service at info@radiosparx.dk or telephone +45 71 99 10 28. When in contact with customer service, the customer must state the telephone number as well as name and address.
The customer is obliged to notify customer service of any change in name, address, or other contact information.
7. Limitations on liability
RadioSparx Scandinavia ApS is under no circumstances responsible for the consequences of the customer’s unlawful use of the content on radiosparx.com or for the customer’s use of content from other sources.
The subscription assumes that the content on www.radiosparx.com is free of fees and that the customer therefore does not have to pay tax to PRS for the customer’s use of the content from www.radiosparx.com.
All rights to the content on radiosparx.com belong to RadioSparx Scandinavia ApS and its content supplier. RadioSparx settles remuneration to rights holders for the use of their music via our content supplier.
RadioSparx Scandinavia ApS guarantees that only music content free from fees is processed on the customer’s music account at www.radiosparx.com
8. Disputes
Any dispute regarding the agreement (standard terms and conditions and the subscription agreement) and the use of radiosparx.com must be settled in accordance with Danish law with the court in Roskilde as the place of jurisdiction.
